Photography Agreement

 

1. Scope of Services

The Photographer provides photography services including family portraits, children’s photography, studio sessions, and outdoor sessions (e.g., parks, urban environments, and recreational or sports locations). Events and corporate portrait sessions may also be covered under similar terms.

 

2. Artistic Style & No Guaranteed Results

The Client acknowledges that photography is a creative service. The Photographer will use professional judgment and artistic style to capture and edit images. Due to the nature of working with children, groups, and outdoor environments, specific poses, expressions, or outcomes are not guaranteed.

3. Image Editing & Retouching Disclaimer

All delivered retouched images will be professionally edited in the Photographer’s signature style.

Editing may include, but is not limited to:

• Color correction and exposure adjustment

• Cropping and composition refinement

• Skin retouching and visual enhancements

The Client understands that editing involves subjective, artistic interpretation based on the original image. Natural-looking enhancements may be applied at the Photographer’s discretion. Final edited images reflect the Photographer’s artistic standards.

Additional retouching requests beyond the Photographer’s standard editing style are not included and may be subject to additional fees.

4. Session Conditions & Client Responsibility

The Client is responsible for the behavior and cooperation of all participants, especially children.

The Photographer is not responsible for missed shots due to uncooperative subjects, lateness, or interruptions.

The Client assumes all risks associated with all sessions.

 

5. Liability & Safety

Participation in the session is at the Client’s own risk. The Photographer is not responsible for any injuries, accidents, or harm that may occur during the session, including those resulting from movements, poses, or guidance provided by the Photographer.

While the Photographer takes reasonable care in capturing and delivering images, liability is limited to the total amount paid for the session.

The Photographer is not liable for indirect, consequential, or incidental damages.

 

6. Weather & Uncontrollable Factors

Outdoor sessions are subject to weather and lighting conditions. The Photographer reserves the right to reschedule if conditions are unsafe or unsuitable.

The Photographer is not responsible for limitations caused by weather, lighting, location restrictions, or public interference.

 

7. Rescheduling & Cancellation Policy

• A deposit may be collected to secure the session date.

• If the Client cancels more than 7 days before the session, the full deposit will be refunded.

• If the Client cancels within 7 days of the session, the deposit is non‑refundable, but one free rescheduling may be allowed, subject to availability.

• Cancellations or rescheduling requests within 2 days of the session are not allowed, and the deposit is non‑refundable.

• If the Photographer cannot attend due to emergency, illness, or equipment failure, the Client may receive a full refund or a free reschedule.

 

8. Copyright & Usage

All images remain the intellectual property of the Photographer.

Clients are granted a personal-use license for non-commercial purposes.

 

9. Model Release & Promotional Use

The Client grants the Photographer permission to use images from the session for portfolio, website, social media, and promotional purposes, including advertising of services.

Clients who prefer privacy must submit a written request prior to or at the time of booking.

 

10. Agreement

By booking a session, the Client acknowledges and agrees to the terms outlined above.
